Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and Klik and govern your use of the Klik website and service. Please read them carefully. By creating an account, creating an event, or uploading content, you agree to these Terms. If you do not agree, do not use Klik.

1. Who we are and definitions

Klik is operated by [KLIK LEGAL ENTITY NAME], registered in [COUNTRY] under number [KvK / COMPANY NUMBER], registered office [REGISTERED ADDRESS] ("Klik", "we", "us").

  • ·"Service" — the Klik website, app, and related features for collecting event photos, videos and messages via a QR code or link.
  • ·"Host" — a person who creates an account and an event.
  • ·"Guest" — a person who uploads content to an event without an account.
  • ·"Content" — photos, videos, messages and other material uploaded to an event.
  • ·"You" — a Host or Guest using the Service.

2. Eligibility and accounts

  • ·You must be at least 18 years old to create a Host account and use the Service as a Host.
  • ·You must provide accurate information and keep your login credentials confidential. You are responsible for activity under your account.
  • ·One account per email address. You may sign in with an email and password, or with Google.
  • ·Guests do not need an account and do not need to be 18, but Guests must have the right to upload the Content they submit.

3. The Service and plans

Klik lets a Host create an event, share a QR code or link, and collect Content from Guests into a gallery that the Host can view, moderate and download.

  • ·Free tier: up to 50 uploads per event, one event per host, and a 30-day storage window after the event, after which Content is deleted (with a short grace period for download).
  • ·Paid plans with higher upload caps and longer storage may be offered. Where paid plans are active, their prices, limits and payment terms are presented at the point of purchase and form part of these Terms.

We may change, add or remove features. We will not materially reduce a paid plan you have already bought during its term without offering a remedy.

4. Host responsibilities

As a Host you are the controller of your event's Content (see our Privacy Policy). You agree that:

  • ·You have a lawful basis to collect your Guests' photos, videos and messages, and you will inform your Guests appropriately about how their Content will be used.
  • ·You will obtain any consents required, including where minors may appear in Content.
  • ·You are responsible for moderating your event and for removing Content you should not keep.
  • ·You will not use Klik to collect Content in a way that is unlawful, deceptive, or that infringes others' rights.

You appoint Klik as your processor for the Content and instruct us to store and display it to provide the Service. Our data-processing commitments are set out in the Privacy Policy and apply as data-processing terms between us.

5. Acceptable use and prohibited content

You must not upload, share or use the Service for Content or conduct that:

  • ·is unlawful, or infringes intellectual-property, privacy or other rights;
  • ·is sexual content involving minors, or any child sexual abuse material — this results in immediate removal, account termination and, where required, reporting to authorities;
  • ·is hateful, harassing, threatening, defamatory, or incites violence;
  • ·contains malware, or attempts to breach, overload, probe or reverse-engineer the Service;
  • ·impersonates others or misrepresents your affiliation;
  • ·scrapes, resells or provides the Service to third parties except as intended (a Host sharing an event link with their Guests is fine).

You must only upload Content you own or have permission to share.

6. Intellectual property and licence

Your content stays yours

Hosts and Guests keep all ownership of the Content they upload. Klik does not claim ownership of your Content.

Licence you grant to us

To operate the Service, you grant Klik a limited, worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, and display your Content solely for the purpose of providing the Service to you and your event's participants — for example, showing photos in the gallery and the live venue screen, generating a shareable preview image, and packaging Content into a downloadable ZIP. This licence ends when the Content is deleted, except for copies in short-lived backups. We do not use your Content for advertising, or to train machine-learning models.

Our intellectual property

The Klik name, logo, brand, and software are owned by Klik and protected by law. These Terms do not grant you any right to use them except as necessary to use the Service.

7. Moderation and removal

  • ·Hosts can hide or delete any upload in their event at any time.
  • ·We may remove Content or suspend or terminate access where we reasonably believe these Terms or the law have been violated, or to protect the Service and its users.
  • ·We are not obliged to monitor Content but may act on reports.

8. Storage, download and deletion

  • ·Content is retained only for the event's storage window and is then deleted. It is your responsibility to download anything you want to keep before the window closes.
  • ·Deleting an upload removes it from galleries immediately and from storage within 24 hours; deleting an event removes all of its Content. Deletion is permanent and cannot be undone.
  • ·We are not a backup service and do not guarantee retention beyond the applicable window.

9. Payments (where applicable)

Paid plans, if offered, are one-off payments per event rather than recurring subscriptions unless stated otherwise. Prices are shown inclusive of applicable taxes where required. Where you are a consumer in the EU, you have a statutory right of withdrawal for certain purchases; by asking us to begin providing a digital service immediately you may lose that right once performance has begun, and we will tell you this at checkout. Refunds are handled as described at the point of purchase and as required by law.

10. Availability and "as is"

We work hard to keep Klik available and reliable, but the Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Content will always be preserved. Nothing in these Terms excludes rights you have as a consumer that cannot be excluded by law.

11. Limitation of liability

To the maximum extent permitted by law, Klik will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us for the event giving rise to the claim in the 12 months before the claim, or (b) EUR 100. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, fraud, or intentional misconduct, or your statutory consumer rights.

12. Indemnity

If you are a Host or a business user, you agree to indemnify and hold Klik harmless from claims, damages and reasonable costs arising out of Content you or your Guests uploaded, your breach of these Terms, or your failure to obtain any consent or lawful basis required for your event. This does not apply to the extent a claim results from our own breach or negligence, and does not affect consumers' statutory rights.

13. Suspension and termination

  • ·You may stop using Klik and delete your account at any time.
  • ·We may suspend or terminate your access if you materially breach these Terms, or where necessary to comply with law or protect the Service or others.
  • ·On termination, your right to use the Service ends; provisions that by their nature should survive (e.g. ownership, disclaimers, liability limits) will survive.

14. Changes to these Terms

We may update these Terms. When changes are material we will update the "Last updated" date and, where appropriate, notify Hosts. If you continue to use the Service after changes take effect, you accept the updated Terms; if you do not agree, you should stop using the Service.

15. Governing law and disputes

These Terms are governed by the laws of [GOVERNING-LAW COUNTRY, e.g. the Netherlands], without regard to conflict-of-laws rules, and the courts of [JURISDICTION] have jurisdiction — except that, if you are a consumer, you benefit from any mandatory protections and courts of the country where you live. The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.

16. General

  • ·If any provision is found unenforceable, the rest remains in effect.
  • ·Our failure to enforce a provision is not a waiver of it.
  • ·You may not assign these Terms without our consent; we may assign them as part of a reorganisation or sale of the business.
  • ·These Terms, together with the Privacy Policy and any plan terms shown at purchase, are the entire agreement between you and Klik regarding the Service.
